Delegation: Can't create delegation while having a unsubscribed/aborted delegation 9.2.1

What i did, i

1. Create a delegation with a recipient and a date range
2. Cancel or unsubscribe the delegation
3. Create the first delegation again (same recipient, responsibility and date range)
4. Throwing error 

is this a OOTB behavior? or this is an issue. coz logically a user should able to create one with same range/res/recipient  even if there is already a unsubscribed or aborted one
